    Equalization of Net Family Property

    With years of experience as a divorce lawyer, I provide clear and effective legal advice. As a general principle, each party is entitled to half of the value of “assets” , including property, savings accounts, investment accounts, “chattels”, etc, after subtracting debts during the parties’ marriage. However, there are occasions when a court will award unequal equalization, based upon a number of factors. It is not unheard of for a spouse to attempt to hide their assets, post separation, or refuse to provide disclosure of their bank accounts. The law is clear: each party must provide full, frank and ongoing financial disclosure. A strong advocate will demand all disclosure and meticulously scrutinize bank accounts and other financial documents to determine whether a spouse is hiding anything.

    a. When there are child protection issues at hand, child protection agencies get involved and commence proceedings. This happens where there are concerns of a child or children’s (18 and under) safety. If there are concerns of physical or emotional harm, child protection agencies like Children’s Aid Societies get involved. There are occasions where the Childrens’ Aid Society will step in and remove and/or supervise access to children. It can be extremely demoralizing and stressful to lose control of parenting to a government organization. There needs to be a delicate balance between advocating passionately and understanding the power CAS has and their influence with the Court System. CAS is considered an independent organization without an agenda and as a consequence, their actions and motives are usually perceived as altruistic and unbiased. This process can become overwhelming and complicated. It is important to involve a divorce lawyer that has experience in dealing with this area of Family law.

My Past Shaped My Present and Future
Marcy Segal spent the first part of her law career as a criminal lawyer and spent two decades practicing criminal law. At all times, her focus was on ensuring that her clients would be treated fairly, regardless of the crime or their guilt or innocence. She was known as a “tough as nails” litigator, resilient to being bullied, or pushed around. After 20 years, 2000 plus court appearances and hundreds of trials under her belt, Marcy decided to transition to family law and has never looked back. As a criminal lawyer, high conflict was the norm. The courtroom became her second home and she became highly skilled in absorbing facts, analyzing people and responding quickly and efficiently. I’m committed to guiding you through every step as your dedicated divorce lawyer.
Working in Family Law
Family Law requires skills in advocacy, both in court, in person and in writing. It requires focus, and retention of facts and financial information of the parties. Family lawyers must be forward thinking from the outset and as they navigate their client through the process. Meticulous scrutiny of the financial records and a succinct narrative are skills that Marcy excels at. Marcy has been exceptionally effective in high-conflict custody battles and believes that every child deserves a healthy relationship with both parents in principle. However, when the best interests of the children equate to one parent having sole custody, My role as a divorce lawyer is to simplify the process and advocate for your needs.

Marcy has litigated in all levels of court in Ontario and before administrative boards. She has acted for lawyers before the law society of Ontario, victims in criminal court, and feels comfortable in any setting. She researches the law obsessively, and is always overprepared.

Education and Hobbies
Marcy was accepted into Law School after two (2) years of undergraduate studies. She attended Osgoode Hall Law School, graduated in 1988 and has been a sole practitioner since her call to the bar in 1990. She is a single mother of twin girls, a marathoner and ironman finisher.
